Transport Department's (TD) Hands are tied
After the first litigation reported on 2003/9/19, TD said it was beyond
their power to control the noise level on buses.
(However, a close read of the legislation in connection with Public
Bus says otherwise.)
2003/3
TD indicated that:
- Bus Spam was initiated by bus companies, i.e. not requested
by bus riders
- revenue generated would be used to lower fare (this reply was
given to us in 2002, but in the latest round of bus fare reduction
proposal, this aspect was not mentioned)
- revenue generated would be used to fund Global Positioning Systems
(GPS) that belong to bus companies (why should People of Hong
Kong funds the research and development of bus companies)
- surveys after surveys, some bus riders did not object to bus
spam and some did oppose the broadcast of bus spam
(that means TD and the bus companies have gone ahead with the
infringing broadcast on public buses despite opposition from bus
riders)
Does Td's reliance on surveys for its actions imply that
- all its actions would be based on surveys
- or just some
- or just those that are convenient to them
- and even if such acts would be against the law and the
Basic Law, Td would still go along with the dictates of
the surveys (during the second world war, Nazi Germany did
just that).
2002
- 靜音區TD suggested setting up of a quiet zone
on double-deckers (靜音區無效或 不足夠或 還未設置靜音區, >> 無效靜音區
)
TD suggested installing of on-off switches for volume control
on mini-buses (in such a small compartment, our field tests have
found such measure to be ineffective).
In
one incident, we were afraid to ask a tattooed passenger to turn
off the broadcast for fear of violent reprisal. (see the latest
news on violence on the street: even fully-armed police force
has been challenged by similarly tattooed people.)
Sometime in 2001, 2002
From the documents presented, it is our believe that audio-visual
broadcast was introduced on mini-buses of Hong Kong again without
consultation with bus riders.
Between 1997 and 2001, it is our believe
that audio-visual broadcast was introduced on public buses of Hong
Kong without consultation with bus riders.

Hong Kong Government
not only fails to carry out its duties but also takes part
in illicit activities such as forcing passengers to listen
and watch its programs on public buses.
- Breach its duty to uphold the Basic
law
- Breach its duty to protect its children
residents
- Breach its fiduciary duty when negotiating
with bus companies
- Breach its duty to International
